Paterson DPW supervisors worked 95 straight hours during storm. Some officials are suspicious

PATERSON — Six supervisors in Paterson’s public works department were paid for working 95 or more consecutive hours — almost the equivalent of 24 hours a day for four days in a row — during the massive snowstorm that hit the region six weeks ago, city records show.

Those extended shifts resulted in substantial overtime hours for the supervisors.

Deputy public works director Manny Ojeda, for example, put in for 134 hours of overtime for the eight days from Jan. 31 through Feb. 7, which amounted to 16.75 overtime hours per day, city payroll records show. The department’s other deputy director, Steve Howe, submitted time sheets for 113 hours of overtime during those eight days, the records show.

The six supervisors were among 26 public works employees — including 17 who drove salt or plow trucks during the storm — whose overtime requisition forms show they put in for 71 or more straight hours of work.

Mayor Andre Sayegh and Paterson Public Works Director William Rodriguez did not respond when contacted about the numerous hours listed on the city overtime records.

“For somebody to go 24 hours and then 24 and 24, I just don’t see it,” said City Council President Flavio Rivera. “Is it even possible?”

Rivera brought some examples of the DPW storm hours to light during a council meeting last month. Paterson Press then filed a public records request and obtained 155 pages of hand-written public works overtime requisitions for the winter storm.

The New Jersey Department of Transportation , which plows and spreads salt on state highways, said it sets a limit on how long its drivers can be on the road.

“Generally, our drivers work no more than 12 consecutive hours,” said DOT spokesman Steve Schapiro. “We also use contractors to support our winter operations.  As part of the terms of their contract, the contractor is responsible for ensuring their drivers have sufficient rest.”

During the winter storm that hit New Jersey on Jan. 31, the DOT had its “winter operations employees shelter in place for their safety and the public’s safety,” Schapiro said.

“This was done to ensure we could seamlessly rotate our shifts to continuously do our job of clearing interstate and state highways without concern for whether employees would be able to make it back in,” Schapiro stated. “This means our employees were on the clock for the entire time. However, plow operators were only operating vehicles for 12 hours a shift.”

Paterson spokeswoman Jessica Diaz said the city’s DPW crews received “rest periods and breaks” during the multi-day storm. But the city did not provide a response when asked about the timing of the drivers’ breaks.

The statement issued by Diaz said that during a state of emergency, like the recent storm, that the DPW is exempt from DOT regulations.

“The department cannot send an employee home with the intention of bringing them back,” the city said in its statement.

But Paterson officials did not respond when asked why they could not send employees home and then bring them back to work after they were rested. The city’s labor contracts include a clause that prevents Paterson from sending DPW workers home during their regular shifts, and then recalling them. But the contracts do not address sending home employees who have already worked extensive overtime.

The Sayegh administration also did not respond when asked why its DPW staff did not use a rotation system among drivers and supervisors during the storm.
